8 CCR §3205 SYNOPSIS

  1. Application:
    • No changes

 

  1. Definitions:

COVID-19 Test

    • Cannot be both self-administered and self-read unless one of the following occurs:
    • Observed by the employer.
    • Observed by an approved telehealth proctor.
    • Tests that to “satisfy this requirement include tests with specimens that are processed by a laboratory (including home or on-site collected specimens which are processed either individually or as pooled specimens), proctored over-the-counter tests, point of care tests, and tests where specimen collection and processing is either done or observed by an employer.”

Face Covering

    • Defined as “a surgical mask, a medical procedure mask, a respirator worn voluntarily, or a tightly woven fabric or non-woven material of at least two layers (i.e., fabrics that do not let light pass through when held up to a light source).”
    • Masks must completely cover the nose and mouth and be secured to the head with ties, ear loops, or elastic bands that go behind the head.
    • Gaiters are allowed when they have two layers of fabric or are folded to make two layers.

Fully Vaccinated

    • Requires the initial vaccination and a second vaccination for when required by the manufacturer. Note: it does not include receiving booster shots.

In a workplace setting, asymptomatic employees in this category are not required to stay home from work if:

        • A negative diagnostic test is obtained within 3-5 days after last exposure to a case
        • Employee wears a well-fitting mask around others for a total of 10 days
        • Employee continues to have no symptoms.

Exposed persons, whether quarantined or not:

        • Should consider testing as soon as possible to determine infection status and follow all isolation recommendations above if tested positive. Knowing one is infected early during quarantine enables (a) earlier access to treatment options, if indicated (especially for those that may be at risk for severe illness), and (b) notification of exposed persons (“close contacts”) who may also benefit by knowing if they are infected.
        • If developing symptoms, should also:
          • Self-isolate and test as soon as possible (do not wait until 5 days after exposure to retest if symptoms develop earlier); AND
          • Continue to self-isolate if test result is positive, and contact their healthcare provider regarding available treatments and any questions concerning their care.

 

8 CCR §3205.1 SYNOPSIS

(Outbreaks of Three or More Employees)

  1. COVID-19 Testing
    • Removed exemption from testing for fully vaccinated employees who are asymptomatic.
    • Added exemption from testing for employees meeting the criteria of §3205(c)(10)(A) and (B), meaning these employees have had COVID-19 and have not had symptoms in at least 90 days since returning to work, or who tested positive for COVID-19 but were asymptomatic, and it has been at least 90 days since they returned to work.
